This Privacy Notice/Policy explains how we collect, use, disclose, store, and protect your personal data in the course of providing our payment, merchant acquiring, and related services. We value your trust and take our responsibility to safeguard personal data seriously.

In the course of our day-to-day business operations, including but not limited to merchant onboarding, account management, transaction processing, fraud prevention, customer support, and compliance with legal and regulatory obligations, we may be required to collect, record, hold, store, use, disclose, and otherwise process your personal and/or financial information (“Personal Data”).

By engaging with us, using our services, or providing your Personal Data to us, you acknowledge that you have read and understood this Privacy Notice/Policy and consent to the processing of your Personal Data in accordance with the purposes and terms set out herein.

We may also contact you from time to time with information relating to our products, services, updates, or matters relevant to your relationship with us, subject always to applicable laws and your communication preferences. 

1.0 Collection of Personal Data

The types of personal data we receive from you including but not limited to (“Personal Data”):

  • Personal information to establish your identity and background;
  • Personal information to establish your financial standing;
  • Personal information to establish your location;
  • Personal information that you provide when you apply for any of our products and services;
  • Personal information that may be required and you provide for risk/fraud management;
  • Sensitive information relating to any past or alleged breaches of offences or convictions under any law;
  • Any other information supplied by you that can indirectly or directly identify you, in order for us to carry out our business with you; and/or
  • Any other information which we deem necessary or appropriate for the Purposes.

To the extent that you disclose to us any personal information and/or personal data (whether or not coming within the definition of Personal Data above) of another individual, we shall assume, without independent verification, that you have obtained such individual’s consent for the disclosure of such information and/or personal data, as well as the Processing of the same in accordance with the terms of this Notice.

2.0 Sources of Personal Data

Your Personal Data is being or is to be collected:

  • when you access or browse our website or application;
  • from your Malaysian Identification Card and/or Passport,
  • when you fill in any forms, letters, agreements and/or contracts for our licenses, products and/or services;
  • from you directly when you submit your Personal Data to us for any of the Purposes;
  • from all other communication between you and us on any subsequent occasion;
  • from any other forms, cards and documents through which we collect information from you;
  • from any events conducted by Share Commerce;
  • from any third parties (including credit reference bodies, regulatory and law enforcement authorities);
  • from all other information that you may provide us from time to time; and
  • from any other resources that we deem appropriate from time to time,

3.0 Use of Personal Data 

The use of the Personal Data is for the following primary purposes (“Purposes”):

  • To administer, process, and assess your application for our payment acquiring products and services.
  • To provide and facilitate payment services, including transaction processing, settlement, refunds, disputes, and chargebacks.
  • To manage and maintain merchant accounts, terminals, systems, and related facilities.
  • To communicate with you regarding our services, transactions, operational matters, and customer support.
  • To perform verification and authentication of personal data, including identity verification and due diligence checks.
  • To conduct transaction monitoring, risk assessment, fraud prevention, detection, investigation, and prosecution of suspected fraudulent or unlawful activities.
  • To comply with applicable laws, regulations, guidelines, and requirements, including those issued by Bank Negara Malaysia and other regulatory or law enforcement authorities.
  • To conduct compliance checks, including anti-money laundering (AML), counter-terrorism financing (CTF), sanctions screening, and risk monitoring.
  • To disclose personal data to relevant third parties such as payment networks, banks, service providers, auditors, professional advisers, or agents, strictly for the purpose of providing our services and meeting regulatory obligations.
  • To respond to enquiries, complaints, disputes, and chargeback cases, and to resolve issues relating to our services.
  • To maintain accurate records, including updating, consolidating, and verifying information with third parties where necessary.
  • For audit, compliance, internal control, and risk management purposes.

We provide a clear Privacy Notice to explain how and why your personal data is collected, how it is used, and how long it will be retained.

You have the following rights in relation to your personal data:

  • To access, correct, or update your personal information,
  • To withdraw consent (where applicable),
  • To request deletion of your personal data, subject to legal and regulatory requirements.

6.1      We may use your Personal Data to provide you with information about our and third-party products and/or services, which may be related to your interests, unless requested otherwise by you.

6.2       We may, in some circumstances, disclose your Personal Data to preferred merchants and strategic partners. Such disclosure will only occur where you have subscribed for particular products and/or services which require such disclosure, and/or where your consent has been obtained, subject at all times to any laws (including regulations, guidelines and/or obligations) applicable to Share Commerce. 

7.0 Employee Access 

At Share Commerce, access to personal data is granted strictly on a need-to-know basis and limited to authorized employees who require such access to perform their job responsibilities. These employees are trained in data protection practices and are bound by confidentiality obligations to ensure that your personal data is processed securely and in accordance with the Personal Data Protection Act 2010 (“PDPA”). Unauthorized access, use, or disclosure of personal data is strictly prohibited and may result in disciplinary action.
